1. Acceptance of Terms & Service Description

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Anonymous SMS ("Company", "Service", "we", "us", or "our"), governing your access to and use of our web application, API, and SMS delivery platform.

By creating an account, purchasing SMS credits, or utilizing our gateway to dispatch messages, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

2. Mandatory User Eligibility

A. Age Requirement (18+)

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to access or use the Service. Persons under 18 years of age are strictly prohibited from creating accounts or placing orders.

B. Mandatory Sobriety Requirement

You are strictly forbidden from accessing, drafting, or executing message dispatches through our network while under the influence of alcohol, illegal narcotics, or mind-altering substances.

3. Strict Anti-Harassment, Misuse & Acceptable Use Policy

We operate an absolute zero-tolerance policy against illegal, predatory, malicious, or harmful usage. You warrant that you shall NOT utilize Anonymous SMS to:

  • Cyberbullying & Stalking: Harass, intimidate, stalk, humiliate, or cause emotional distress to any individual.
  • Threats & Violence: Transmit threats of physical violence, murder, self-harm, arson, terrorism, bomb threats, or illegal harm against people, animals, or property.
  • Hate Speech & Discrimination: Send content that promotes hatred, discrimination, or violence based on race, ethnicity, religion, disability, gender, age, or sexual orientation.
  • Extortion & Blackmail: Solicit money, favors, or actions through threats, coercion, or blackmail.
  • Impersonation of Official Entities: Impersonate law enforcement officers, emergency services (911/000/112), government agencies, financial institutions, or healthcare providers.
  • Spam & Phishing: Distribute high-volume unsolicited commercial messages, multi-level marketing traps, financial scams, credential harvesting links, or malware.
  • Interference with Emergency Services: Send messages intended to disrupt first responders, healthcare facilities, or public safety infrastructure.

4. Commercial Billing, Payments & Strict No-Refund Policy

All transactions are processed in your local currency via PCI-DSS compliant channels (Credit Card, Google Pay, Apple Pay).

Zero-Refund & Non-Reimbursable Policy

Due to immediate gateway provisioning, telecommunication carrier fees, and non-recoverable routing costs, ALL PURCHASES ARE FINAL AND NON-REFUNDABLE.

  • Unused SMS credits cannot be exchanged, returned, or refunded under any circumstances.
  • Delivery failures resulting from invalid destination numbers, recipient carrier blocking, handset power-offs, or spam filters are non-refundable.
  • Filing fraudulent credit card chargebacks will result in immediate permanent account termination, blacklist reporting, and referral to debt recovery and fraud investigation authorities.

5. Telecommunication Carrier Reliance & Service Availability

Anonymous SMS acts as a transmission gateway. Delivery of SMS messages relies on third-party mobile network operators (MNOs) and international aggregators. We do not guarantee 100% delivery success rates, message delivery speeds, or error-free transmission. The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis.

6. Account Termination & Law Enforcement Cooperation

We reserve the right to immediately suspend, terminate, or revoke access to your account without prior notice or credit reimbursement if automated heuristic engines or abuse reports flag a violation of these Terms.

While we maintain a zero-log infrastructure regarding message body storage, we reserve the right to cooperate fully with law enforcement authorities and court orders investigating criminal activity, threats to life, or child exploitation.
